Terms of Service

Subject to the terms and conditions of this Agreement and your obligations hereunder, AKOS grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Application solely for your personal, non-commercial use. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Application, use of the Application, or access to the Application without express written permission from AKOS. You must not use the Application in any way that causes, or may cause, damage to the Application or impairment of the availability or accessibility of the Application; or in any way which is unlawful, illegal, fraudulent or harmful. AKOS reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

The Application and its original content, features, and functionality are and will remain the exclusive property of AKOS and its licensors. The Application is protected by copyright, trademark, and other laws of India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of AKOS. All intellectual property rights subsisting in respect of the Application belong to AKOS and all rights under applicable law are hereby reserved. You shall not take any action to jeopardise, limit or interfere in any manner with AKOS’s ownership of or rights with respect to the Application.

By using the Application, you represent and warrant that:

• You are at least 18 years of age and have the legal capacity to enter into this Agreement.
• All registration information you submit is accurate and truthful.
• You will maintain the accuracy of such information at all times.
• Your use of the Application does not violate any applicable law or regulation.
• You will not use the Application to engage in any activity that constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any local, state, national, or international law.
• You will not use the Application to transmit or procure the sending of any unsolicited or unauthorised advertising or promotional material.

THE APPLICATION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AKOS DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APPLICATION OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. AKOS MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE APPLICATION’S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS APPLICATION AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS OR OMISSIONS IN THE CONTENT OF THE APPLICATION.

You agree to indemnify, defend and hold harmless AKOS and its officers, directors, employees, agents, licensors, suppliers and any third-party information providers to the Application from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement by you. AKOS reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with AKOS in asserting any available defences.

The Application may link to other websites or resources on the Internet, and other websites or resources may contain links to the Application. When you access third-party websites, you do so at your own risk. These other websites are not under AKOS’s control, and you acknowledge that AKOS is not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply endorsement by AKOS or any association with its operators.

By registering for an account on the Application, you agree to receive text messages, phone calls, and emails from AKOS for transactional, promotional, and informational purposes related to the services you have availed. This includes appointment reminders, health tips, offer notifications, and service updates. You may opt out of promotional communications at any time by contacting us at hello@akosmd.in. Transactional messages related to your active services may not be opted out of.

This Agreement shall be governed by and construed in accordance with the laws of India. You irrevocably agree that the courts of New Delhi shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims). Nothing in this clause shall limit the right of AKOS to take proceedings against you in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by the law of such other jurisdiction.

You agree to comply with all applicable local, state, national and foreign laws, rules and regulations in connection with your use of the Application and the services offered therein, including without limitation those related to data privacy, electronic communications and healthcare regulations applicable in India. The use of AKOS services must at all times remain in accordance with the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and all other applicable regulations in force from time to time.

This Agreement constitutes the entire agreement between you and AKOS with respect to the Application, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the customer and AKOS with respect to the Application. A printed version of this Agreement shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. The failure of AKOS to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder.

AKOS is committed to protecting your privacy. Your use of the Application is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please review our Privacy Policy to understand our practices. By using the Application, you consent to the collection, use and disclosure of your personally identifiable information as described in the Privacy Policy.

When you use the Application, AKOS may collect certain personal information such as your name, contact details, health records, and other data necessary to provide you with healthcare services. This information is used solely for the purpose of facilitating the services you have requested, improving the Application, and communicating with you about your health and the services provided by AKOS. AKOS will not sell, trade, or rent your personal information to third parties without your prior explicit consent, except as required by law or as described in the Privacy Policy.

AKOS reserves the right to change or modify these Terms of Service at any time and in its sole discretion. If AKOS makes changes to these Terms, AKOS will provide notice of such changes by updating the date at the top of these Terms, and your continued use of the Application will confirm your acceptance of the changes. If you do not agree to the amended Terms, you must stop using the Application. We encourage you to review these Terms whenever you use the Application to stay informed of the terms and conditions governing your use of the Application and our services.
